BY SUBMITTING YOUR PAPER TO BE CONSIDERED FOR INCLUSION IN PUBLICATION, YOU AGREE TO FOLLOW AND BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT WISH TO BE BOUND BY THESE TERMS AND CONDITIONS YOU MAY NOT SUBMIT YOUR PAPER FOR PUBLICATION.
Agreeing to these Terms and Conditions forms an Agreement between you and QUEUC.
You represent and warrant that you are authorized to enter into this Agreement on behalf of yourself and that all information provided about yourself including your affiliated research institution that you purport to represent is truthful and accurate.
“Author” (“you”) refers to the person submitting Paper, as initiated through the associated online submission form to which these Terms and Conditions are attached.
“Conference” refers to the most recent edition of the research event organized by QUEUC, during which Author presented the content of their Paper to an audience of peers at Bishop’s University, Sherbrooke, QC. Conference is known, synonymously to the name of the organizing entity, as QUEUC (or Quebec Universities English Undergraduate Conference). For clarity in these Terms and Conditions, “Conference” refers to the event, while “QUEUC” refers to the entity that organizes Conference, and publishes Publication.
“Editing Period” refers to the total duration of time from the moment Author’s Paper is conditionally accepted for Publication until Author submits the final draft of Paper to Primary Editor.
“Finalization Period” refers to to the total duration of time from the moment Author submits final draft of Paper to Primary Editor until the Publication Date. Author will have no active responsibilities during Finalization Period, as this will be the time when QUEUC is preparing Publication internally.
“Paper” refers to the content of the research essay submitted by Author for Publication, which must be equal or reasonably similar to the content of the research essay presented by Author at Conference.
“Publication” refers to the final document acting as the yearly publication of Conference Proceedings by QUEUC that is intended to be created during this collaboration. Author is submitting Paper for consideration to be included in Publication, and Paper may or may not be included in Publication.
“Publication Date” refers to the date Publication is made publically available online through the QUEUC website: www.queuc.com
“Primary Editor” refers to a senior student who acts as a representative of QUEUC, and is assigned by QUEUC to work with Author during the Editing Period to edit and refine the quality of paper. Primary Editor will serve as Author’s first person to contact on behalf of QUEUC for all matters relating to Publication during the Editing Period.
“QUEUC” refers to the publisher of Publication, its successors, and representatives. QUEUC is the owner of Publication and the party Author enters in Agreement with by agreeing to these Terms and Conditions.
“Secondary Editor” refers to graduated students, who have at least completed a Bachelor level of Education, and professors, who have at least completed a Doctorate level of Education, who may also contribute to the editing of Paper during the Editing Period.
“Submission Period” refers to the total duration of time from the moment QUEUC announces via email that submissions are being considered for Publication until the moment Author is notified as to whether their Submission has been accepted for Publication.
“Third Party Materials” refers to proprietary third party materials which are incorporated into Paper including without limitation reproductions of photography, artwork, film stills, maps, historic documents, video, and text.
2. TERM AND TERMINATION
This Agreement shall remain in full force and effect from the moment Author submits Paper for Publication until either (1) QUEUC informs Author that Paper will not be published in Publication or (2) Publication Date, whichever comes first. Even after termination of Agreement, the Intellectual Property Section will remain in effect, except in instances otherwise noted.
2.2. Early Termination
Either party has the right to terminate this agreement at any time, for any cause, without prior notice. In the event of early termination, QUEUC will cease any work outlined in this Agreement immediately, and the entire Agreement inclusive of the Intellectual Property section will become null and void.
To be eligible to participate in Publication, you must have presented Paper at Conference. By submitting, you warrant and represent that the content of Paper is equal or reasonably similar to the content of the research essay presented at Conference. Reasonable differences in content between Paper and research essay presented at conference may include without limitation: paratext that was omitted during presentation including without limitation name of Author, footnotes, bibliographic references, and page numbers; paragraphs and arguments that were omitted during presentation to tailor research essay to presentation requirements; revisions that were made to content of research essay between presentation at Conference and Submission Period including without limitation spelling and typographic changes, changes in phrasing and word choices, changes of structure, changes in argumentation and rhetoric, and changes in paratext such as Third Party Materials attached to submission. QUEUC reserves the right to evaluate whether changes in Paper are reasonable based on research essay that was submitted for presentation at Conference, and to include or exclude Paper from Publication accordingly.
4. FEES AND CHARGES
Participation in Publication is voluntary. QUEUC will not charge Authors any fees at any time for the submission, evaluation, editing, or publication of paper. Author will not expect any compensation monetary or otherwise from QUEUC for Author’s contribution to Publication. Publication is a non-commercial student-run initiative completed for academic purposes. No financial transaction will occur at any time between QUEUC and Author in relation to the work outlined in this Agreement.
5. INTELLECTUAL PROPERTY
5.1. Governing Law
Intellectual Property in Publication, and as defined in these Terms and Conditions shall be interpreted in accordance with the Copyright Act of Canada.
5.2. Publisher Trademarks and Content
QUEUC shall remain the sole Copyright holder of all QUEUC trademarks and other content for which QUEUC is the primary Copyright holder. No terms in this Agreement shall be construed as an assignment of copyright ownership to Author of content for which Author was not the primary Copyright holder prior to entering this Agreement.
5.3. Grant of Publishing Rights
Author hereby grants and assigns to QUEUC, for the full term of the copyright of the work, the sole and exclusive non-transferrable First Worldwide Electronic Publication Right to publish Paper in the English language, (2) non-exclusive, non-transferable, Republishing Rights of Paper in electronic, print, or any other medium, for non-commercial purposes, (3) non-exclusive non-transferable Excerpt Rights.
5.4. Reversal of All Copyright
In the event of early termination of this Agreement, all rights return to Author.
5.5. Author Warranties and Indemnity
Author warrants that Author is sole creator and proprietor of Paper; that Paper has not heretofore been published in any form; that Author is the owner of all rights granted to QUEUC; and that Author has full power in enter into this agreement; and that said rights are not subject to any proper agreement, lien, or other claim or rights which may interfere with the rights herein granted; that Paper is original and not in the public domain; that Paper does not violate the right of privacy of any person; that Paper contains no libelous, obscene, or other unlawful matter; and that Paper does not infringe upon the copyright or violate any other right of any person or party. Author agrees to hold QUEUC harmless against any damages, including attorney’s fees, finally sustained in any suit involving QUEUC by reason of violation of these warranties.
5.6. Third Party Content
Intellectual Property rights in Third Party Materials shall be owned by the respective Third Parties. Author is responsible for (1) securing all permissions to reproduce any materials in Paper for which Author is not the primary Copyright holder in a way that is consistent with the rights granted herein; and (2) paying all costs associated with obtaining such permissions. Author shall indemnify, save and hold harmless QUEUC from any damages, liabilities, costs, losses or expenses arising out of any claim, demand, or action by a third party arising out of Author’s request or failure to obtain copyright, trademark, publicity, privacy, defamation, or other releases or permissions with respect to materials included in Paper at Author’s request.
6. PUBLICATION PROCESS
By submitting Paper, Author agrees to participate in the Publication Process outlined by QUEUC, and communicated by QUEUC on the QUEUC website (www.queuc.com). Publication Process will include a Submission Period, an Editing Period, which may be further subdivided into up to three rounds of editing, and a Finalization Period; Publication Process will end on Publication Date.
6.1. Author Responsibilities
Author agrees to follow the steps of the Publication Process, including being available for regular collaboration with the Primary Editor over the duration of the Editing Period, responding to all communication from QUEUC in a timely manner, and attending to the process of revision and editing as guided by the Primary and Secondary Editors. Author understands that the eventual publication of Paper is conditional on Author revising Paper in collaboration with the Editors over the Editing Period. Failure to respond to communication, meet deadlines, make necessary revisions, or to meet any other responsibilities or requirements outlined in this Agreement may result in QUEUC terminating this Agreement with Author.
6.2. QUEUC Responsibilities
QUEUC agrees to communicate all aspects of the Publication Process to author including and up to (1) Publication Date or (2) termination of this agreement in writing, including without limitation informing the author that Paper has not been selected for Publication in the Submission Period, whichever comes first. These communication responsibilities include without limitation announcing the start of the Submission Period, the selection decision made by Publication’s editorial board, the requirements and deadlines of the editing process, and Publication Date. QUEUC is responsible for holding a fair, equitable, peer-reviewed selection process to admit Paper into publication, and for providing academic guidance for Author to revise Paper during Editing Period.
6.3. Changes to Paper
Author will be guided by QUEUC during the Editing Period to make changes to Paper, with the goal of strengthening the academic quality of Paper. Author will have the power to decide whether to follow revision recommendations made by QUEUC at all stages of the Editing Period. At the end of the Editing Period, Author will have the opportunity to make final revisions and submit a final draft to QUEUC. Author is responsible for ensuring final draft is free of language errors including without limitation, spelling and typographic errors, grammar errors, syntax errors and lexicon errors. QUEUC reserves the right to make minor changes to Paper in the Finalization Period after Author has submitted their final draft of Paper. Such minor changes may include without limitation: correcting a language error that was not previously fixed; and editing word choices and phrasing, while staying as close to the intended meaning as possible, in order to adapt Paper to the final layout. On the Publication Date, Author will have the opportunity to review Publication and contact the editors to correct any errors to Paper that have not yet been caught.
QUEUC EXPRESSLY DISCLAIMS ANY WARRANTIES AND CONDITIONS OF ANY KIND WHETHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE WARRANTIES OF ACADEMIC SUCCESS, AUDIENCE APPEAL, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, PEER APPROVAL, INSTITUTIONAL SUPPORT, OR NON-INFRINGEMENT.
8. LIMITATION ON LIABILITY
QUEUC SHALL NOT BE LIABLE TO AUTHOR OR ANY THIRD PARTY FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING ANY LOST PROFIT DAMAGES ARISING FROM AUTHOR’S PARTICIPATION IN PUBLICATION, EVEN IF QUEUC HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9. RELATIONSHIP OF PARTIES.
Author and QUEUC are independent entities, and nothing in this Agreement will create any partnership, joint venture, agency, franchise, sales representative, or employment relationship between the two parties. Author has no authority to make or accept any offers or representations on QUEUC’s behalf. Author will not make any statement, whether on Author’s personal websites or Author’s social media accounts, or in Paper, that would reasonably contradict anything in this section.
